Terms of Service

These Terms of Service (“Terms”) govern your use of the upnext mobile application and any related services (collectively, the “Service”) operated by Maisam Ali (“we”, “our”, or “us”).

By downloading, installing, or using upnext, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1.Eligibility

You must be at least 13 years old to use upnext. By using the Service, you represent and warrant that you meet this requirement. If you are between 13 and 17, you confirm that your parent or guardian is aware of your use of the app.

We reserve the right to terminate accounts of users who misrepresent their age.

2.Your Account

Creating an Account

To access most features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

Account Security

You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account. Notify us immediately at designitmaisam@gmail.com if you suspect any unauthorised use of your account.

Account Termination

You may delete your account at any time from Profile → Settings → Delete Account. We may suspend or terminate your account if you violate these Terms or engage in conduct harmful to other users or the Service.

3.Use of the Service

Permitted Use

upnext is a personal productivity tool for managing your academic schedule, tasks, and study materials. You may use it solely for lawful, personal, non-commercial purposes.

Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws
• Attempt to gain unauthorised access to any part of the Service or its infrastructure
• Reverse engineer, decompile, or disassemble any part of the app
• Scrape, harvest, or collect data from the Service using automated means
• Impersonate another person or create fake accounts
• Upload or transmit malicious code, viruses, or any content that could harm others
• Use the Service to harass, abuse, or harm other users
• Interfere with or disrupt the integrity or performance of the Service

4.User Content

You retain ownership of all content you create within the app — including class schedules, assignments, notes, and tasks (“User Content”). By using the Service, you grant us a limited, non-exclusive licence to store and process your User Content solely to provide the Service to you.

You are solely responsible for your User Content. We do not review or endorse any User Content and are not liable for any content you create or share.

5.AI Features

upnext uses Google's Gemini AI to extract timetable information from photos you provide. By using the AI timetable scanner, you acknowledge that:

• Your timetable image is sent to Google's servers for processing
• AI extraction may not be 100% accurate — you should always review and confirm the extracted schedule
• We are not responsible for any inaccuracies in AI-generated output
• Timetable images are not retained after processing

6.Intellectual Property

All rights, title, and interest in and to the Service — including the upnext name, logo, design, code, and all related intellectual property — are and remain the exclusive property of Maisam Ali.

Nothing in these Terms grants you any right to use our trademarks, logos, or brand elements without our prior written consent.

7.Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please read it carefully to understand how we collect, use, and protect your information.

8.Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We are not responsible for any loss of data, missed deadlines, or academic outcomes arising from your use of the app.

9.Limitation of Liability

To the fullest extent permitted by law, Maisam Ali shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of profits, or loss of goodwill — arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months prior to the claim (if any).

10.Third-Party Services

The Service integrates with third-party services including Supabase, Google (Gemini AI and Sign in with Google), Apple (Sign in with Apple), and OneSignal. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or content of any third-party services.

11.Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you via the app before the change takes effect. Your continued use of the Service after the effective date constitutes your acceptance of the updated Terms.

We encourage you to review these Terms periodically.

12.Governing Law

These Terms are governed by the laws of Pakistan. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of Pakistan, without regard to conflict of law principles.

If you are located in the EU or UK, you retain the right to bring claims before your local courts or data protection authority as required by applicable law.
